Terms, Conditions & Cancellation Policy
These Terms and Conditions govern the contractual relationship between Guillermo Bernal Pike, operating commercially as White Island Charter (hereinafter “White Island Charter”, “we”, “our”, or “us”), the client (hereinafter “the Client”, “you”, or “your”) for all vessel charter services arranged through our website whiteislandcharter.com or by any other means of communication.
By completing a booking, the Client acknowledges having read, understood, and accepted the entirety of these terms on behalf of themselves and all passengers included in the reservation.
1. Legal Status of the Vessels
All vessels offered through White Island Charter hold a valid charter licence, carry mandatory civil liability insurance, and are equipped with all safety gear required under current Spanish maritime legislation.
Certain vessels within our fleet may be owned by independent third-party owners who operate under their own charter permits. Where this is the case, the specific conditions applicable to each vessel are set out in its individual specification sheet. The
Client is responsible for reviewing these conditions prior to departure; unfamiliarity with such conditions does not exempt the Client from compliance.
2. Booking Confirmation
A booking is considered confirmed only once the following two conditions have been met simultaneously:
- White Island Charter has received a deposit equal to 50% of the total charter price; and
- Written confirmation has been issued by White Island Charter (via email or other documented means).
Until both conditions are fulfilled, availability is not guaranteed and no contractual obligation arises on either party
3. Payment Terms and Methods
Payment Schedule
- 50% of the total charter price is due at the time of booking to secure the reservation.
- The remaining 50% must be settled in full before embarkation. Under no circumstances may the Client board the vessel with an outstanding balance.
Accepted payment methods
All amounts are denominated and payable in euros (€). The following payment methods are accepted:
- Bank transfer (no surcharge).
- Payment link – subject to a processing surcharge of 2–3%, depending on the provider.
- Credit or debit card (Visa, MasterCard) – no surcharge.
- American Express – subject to a 2.5% surcharge.
- Cash – accepted only by prior written agreement.
White Island Charter reserves the right to modify accepted payment methods and applicable surcharges at any time, with any changes communicated to the Client before payment is due.
4. Charter Price
Included in the price
Unless otherwise expressly stated in the booking confirmation, the charter price covers:
- Hire of the vessel for the agreed duration (standard charter: 8 hours).
- Mooring at the vessel’s assigned base port for the duration of the charter.
- Vessel hull insurance and third-party liability insurance.
- Standard post-charter cleaning.
- Courtesy equipment and amenities as listed on the vessel’s specification sheet.
Not included in the price
The following items are expressly excluded from the charter price and represent additional costs borne by the Client:
- Fuel (see Section 5 below).
- Professional skipper services, unless specifically included in the booking confirmation.
- Mooring or berthing fees at ports other than the vessel’s base port.
- Any additional services, extras, or consumables not mentioned in the booking confirmation.
5. Fuel
Unless the booking confirmation expressly states that fuel is included, all fuel costs are the sole responsibility of the Client. Fuel consumption is settled at the end of the charter in accordance with the measurement system installed on the vessel (fuel
gauge, flow meter, or tank refill). The applicable fuel rate will be communicated to the Client before departure.
6. Skipper and Security Deposit
Skipper requirement
Certain vessels in our fleet must be operated by a professional skipper provided by White Island Charter. Other vessels may be chartered without a skipper, provided the Client holds a valid navigation licence recognised in Spain and appropriate for the
vessel’s category and navigation area.
It is the Client’s responsibility to present the original licence before departure. White Island Charter reserves the right to refuse to hand over a vessel if the Client is unable to produce a valid and sufficient licence.
Security deposit
A security deposit is mandatory for all bareboat (without skipper) charters. The deposit amount is specified per vessel on its specification sheet and must be paid or pre-authorised before the vessel is handed over.
The deposit will be returned in full after a satisfactory post-charter inspection confirms that the vessel has been returned in the same condition as delivered, with no damage, missing equipment, or outstanding charges. Any costs arising from damage, excessive cleaning, missing items, or other uncovered expenses will be deducted from the deposit. Should the costs exceed the deposit amount, the Client shall be liable for the difference.
7. Charter Duration and Schedule
The standard charter duration is 8 hours, typically from 10:00 to 18:00 or from 12:00 to 20:00, and must always fall within daylight hours in accordance with the vessel’s charter licence conditions.
Extensions beyond the agreed duration are subject to prior approval by White Island Charter, availability of the vessel, and an additional time-based surcharge communicated to the Client in advance. Unauthorised extensions may result in penalty charges.
8. Base Port and Mooring
Each vessel is assigned a designated base port, and the cost of mooring at this port is included in the charter price. The vessel must depart from and return to its base port unless otherwise agreed in writing.
Any mooring, berthing, or port fees incurred at locations other than the base port during the charter are not included in the price and shall be borne entirely by the Client.
9. Maximum Passenger Capacity
In accordance with Spanish maritime regulations, the maximum number of passengers permitted on board recreational charter vessels is 12 persons (excluding crew).
Only vessels holding a specific passenger-vessel certification (categorised as “MY” or equivalent under Spanish law) may carry more than 12 passengers. The certified maximum capacity is stated on each vessel’s documentation and must not be exceeded under
any circumstances. White Island Charter reserves the right to refuse embarkation if the passenger limit is exceeded.
10. Additional Services
White Island Charter can arrange supplementary services upon request, including but not limited to catering, water toys and inflatables, land transfers, restaurant reservations, and on-board entertainment
Additional services may be provided by third-party suppliers and may carry their own specific terms and cancellation conditions, which will be communicated to the Client before confirmation. White Island Charter acts solely as an intermediary for third-party
services and accepts no liability for their performance, quality, or availability
11. Cancellation Policy
All cancellations must be submitted in writing to info@whiteislandcharter.com. The date on which the written cancellation is received by White Island Charter shall determine the applicable cancellation fee according to the schedules below.
11.1 Day Charters (no overnight stay)

Cancellation fees are calculated on the total charter price, not solely on the deposit paid. Any amounts owed beyond the deposit already held will be invoiced to the Client.
11.3 Adverse Weather and Safety Conditions
The safety of our clients and crew is our absolute priority. If weather conditions or sea state make it unsafe or inadvisable to proceed with the charter, the following applies:
- White Island Charter will offer a rescheduled date subject to mutual availability
- If rescheduling is not possible within the current season, a full refund of all amounts paid will be issued.
The decision to cancel or postpone a charter due to weather or safety is made at the sole discretion of White Island Charter and/or the appointed skipper, based on real-time assessment of sea conditions, official weather forecasts, and port authority advisories. This decision is final and not subject to dispute.
For the avoidance of doubt, conditions that may justify cancellation include, but are not limited to: wind speeds exceeding the vessel’s safe operating thresholds, significant wave height warnings, thunderstorm alerts, restricted visibility, and any official
maritime safety notices issued by the relevant harbour authority.
12. Late Arrival and No-Show
The Client is expected to arrive at the base port at the agreed time. If the Client has not arrived within 60 minutes of the scheduled departure time and has not communicated a delay to White Island Charter, the charter may be treated as a no-show.
In the event of a no-show, White Island Charter reserves the right to cancel the charter without refund. Late arrival by the Client does not entitle the Client to an extension of the charter duration; the charter will end at the originally agreed time
regardless of the actual departure time.
13. Client Responsibilities and Conduct
The Client and all passengers agree to:
- Comply with the instructions of the skipper and crew at all times, particularly regarding safety procedures, navigation, and use of on-board equipment.
- Treat the vessel, its equipment, and furnishings with reasonable care and report any damage or malfunction immediately
- Refrain from any behaviour that may endanger the safety of persons on board, other vessels, or the marine environment.
- Comply with all applicable maritime laws, port regulations, and environmental protection rules, including the prohibition of anchoring over Posidonia oceanica seagrass meadows in the Balearic Islands.
- Not use the vessel for any unlawful purpose, including but not limited to smuggling, drug trafficking, or illegal fishing.
White Island Charter and/or the skipper reserves the right to terminate a charter immediately and return to port if the Client or any passenger engages in dangerous, illegal, or seriously disruptive behaviour. In such cases, no refund will be issued.
14. Limitation of Liability
White Island Charter’s liability is limited to the total charter price paid by the Client. We shall not be liable for indirect, incidental, or consequential damages of any kind, including loss of enjoyment, travel expenses, or accommodation costs.
White Island Charter is not responsible for personal belongings brought on board. Clients are advised not to bring valuables onto the vessel and to ensure their own personal travel insurance is in place for the duration of their trip.
In cases where the vessel is owned by a third party, liability for vessel defects or mechanical failure rests with the vessel owner in accordance with the applicable charter agreement and Spanish maritime law.
15. Force Majeure
White Island Charter shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, epidemic or pandemic
restrictions, war, terrorism, government orders, port closures, strikes, and severe weather events.
In force majeure situations, White Island Charter will make every reasonable effort to offer the Client an alternative date or a full refund.
16. Applicable Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Spain. Any dispute arising from or in connection with these terms shall be submitted to the jurisdiction of the courts of Ibiza (Illes Balears), except where mandatory
consumer protection legislation establishes otherwise.
17. Acceptance
By completing a booking – whether online, by email, by telephone, or in person – the Client expressly confirms acceptance of these Terms, Conditions, and Cancellation Policy on behalf of themselves and all passengers included in the reservation. The Client
further confirms that they have the authority to accept these terms on behalf of all such passengers.
